Agent Partner Moves Family Business to 3CU, Cites Strong Belief in 3CU Model and Values

craneWith more than 30 years in the insurance business, Don Denbo, owner and president of Commercial Insurance Associates in Brentwood, Tenn., says the biggest challenge is finding partners who share his same approach to workers’ compensation. That’s why he’s such a believer in 3CU. “3CU exemplifies everything I have believed in for not only my own business, but my clients’ businesses,” Denbo said.

Denbo is not only one of 3CU’s trusted agent partners – he’s also a valued policyholder. He moved his family’s fourth-generation scrap metal business, Tennessee Valley Recycling to Third Coast Underwriters earlier this year. Underwriting Manager Jerry Self says that CNA, who was the previous carrier on the account for several years, had recently moved away from the scrap metal business, but remained aggressive on pricing for the account. “Don told me that he wanted to put his family business with 3CU because our values were the same and we were selective in what we do,” Self says. “He also had other options that were less expensive, but he trusted our approach.”

Denbo has been a supporter of 3CU from the start. When Self joined the 3CU team, Denbo contacted him and sold Self and the rest of the 3CU team on how scrap metal dealers would be a great fit for the 3CU business model. As a result, it’s become a successful segment for 3CU and we write four of Denbo’s larger accounts in this segment.

“Workers’ compensation insurance is both terribly simple and terribly complicated. It comes down to pre-loss, what you do through training before an injury occurs, and post-loss, how you respond to that injury,” Denbo explained. “3CU has excellent people to handle both of these issues. Midwest Regional Loss Control Manager Dave Brandolino is a great believer in the human element approach to loss control and the impact of behavioral adjustment, which we’ve been doing for a long time as well. And Director of Claims Brad Schmitt is one of the best people I know in the industry, he’s just extraordinary.”

Denbo also has placed other business outside of his scrap metal accounts with 3CU, including a mergers and acquisitions account, but says that agents should keep a customer’s culture in mind when considering 3CU. “The first thing we consider when placing business is the culture of our prospective client,” Denbo said. “If the cultures don’t match, if they’re not going to accept the 3CU approach, then you’ve made a mistake. Luckily for us, our cultures match perfectly.”

3CU Sees Growth Success in Variety of Ways

growthAs mentioned in the previous edition of The Angle, profitable growth is a top priority for Third Coast Underwriters (3CU) in 2014. We are continuing to pursue our expansion into the Southeast and penetrate further into the Gulf region, but we’re also seeing other exciting areas of growth as well:

  • Growth of premium and underwriting gain: As of April 30, direct written premium is up 13.5% from the same period in 2013. Our calendar year underwriting gain has also increased for the same period versus 2013, up 48%.
  • Growth of agency partnerships: In early May, 3CU held our first Agency Partnership Event in Chicago where we brought in select agency partners for dinner and discussions with our executive team. It was a great opportunity for us to get to know attendees better as well as gain their feedback on our strengths as a carrier, how we can better service our agents and your customers and their overall view of the current state of the industry. We look forward to doing similar events in the future and continue building our relationships with each of you.
  • Growth of our team: As part of commitment to better serve you and your customers, 3CU continues to add resources so we can ensure that we meet all your needs. To that end, we’ve recently added four individuals possessing the expertise and experience you’ve grown to expect. They are:
    • Senior Underwriting Technical Advisor Gary Booth, who is based in Charlotte, N.C.
    • Claims Consultant Bonnie Brown, who is based in our Chicago office.

Segment Leaders Knowledge Center Connects Customers to 3CU Expertise

Legislative Update

Legislative Update is a brief synopsis of legislative activity currently taking place relevant to 3CU and the Accident Fund Holdings (AFHI) enterprise’s work comp interests. For more details or further documentation on any of these legislative activities, contact your underwriter.

Federal

The House Financial Services Committee recently enacted a TRIA reauthorization proposal, the Terrorism Risk Insurance Modernization (TRIM) Act of 2014. House and Senate committees have passed differing versions of reauthorization. Accident Fund Holdings (AFHI) continues to work with our allies in Congress, most recently going to Washington and highlighting the challenges workers’ compensation insurers face when it comes to terrorism risk. Last week, AFHI sent a letter supporting TRIA reauthorization to all House Financial Services Committee Members. AFHI secured nine carrier CEO signatures, representing six states including Michigan, Maine, Ohio, Wisconsin, Arizona and Iowa.

Although TRIA doesn’t expire until Dec. 31, 2014, AFHI feels Congress must act now and delay reauthorization no longer.

State

Wisconsin

After recent criticism regarding the composition of the Workers’ Compensation Advisory Council, Department of Workforce Development Secretary Reggie Newson communicated he has no intention of altering the group. The council is comprised of five voting representatives from organized labor, five voting management representatives, three non-voting representatives from the insurance industry and one representative from the department. It also has liaison representatives for medical providers. Newson said that moving forward, the department take the concerns from all segments of the business community into account. AFHI will continue to monitor this situation and any potential amending of the Wisconsin agreed bill process.

Kansas

The Kansas Workers’ Compensation Insurance Plan Governing Board recently voted to recommend to the Kansas Insurance Commissioner that NCCI be awarded the Kansas Workers’ Compensation Insurance Plan Administration contract beginning Feb. 1, 2014, through Dec. 31, 2019, with the option for two three-year renewals. The delay in the approval past the effective date of the contract was due to extra time taken by the Kansas Department of Administration to review the bids submitted by NCCI and Aon Risk Solutions.

A meeting of the Kansas Workers’ Compensation Insurance Plan Governing Board was held in May to review the competing bids and vote to make a recommendation to the Insurance Commissioner to award a contract. The board, which is appointed by the Insurance Commissioner, voted 6-1 in favor of NCCI, with one member abstaining and one member not present.

Michigan

Michigan Senate Approves State Bill 211 Substitute-4(S-4)

The Michigan Senate approved Senate Bill 211 Substitute-4(S-4), introduced by Tory Rocca (R-Sterling Heights). As introduced, the bill would have amended the Workers’ Disability Compensation Act of 1969 to provide a statutory presumption that, for a member of a fully-paid fire department, all “respiratory tract, bladder, skin, brain, kidney, blood, thyroid, testicular, prostate and lymphatic cancers” would be deemed to have arisen out of the workplace and, therefore, be eligible for workers’ compensation benefits. The bill has been introduced in the legislature each of the past five sessions.

In pursuing an alternative proposal, AFHI worked closely with Senate leadership and the firefighter community. The alternative, enacted by the Senate, would create a state-funded fund from which firefighters with certain illnesses could claim benefits directly, thus leaving the existing workers’ compensation system untouched. The bill now moves to the House for further consideration.

Appeals Court Tosses Out Claim To Open MCCA Records

Records of the Michigan Catastrophic Claims Association (MCCA) are not subject to public review under the Freedom of Information Act (FOIA), the Court of Appeals ruled recently, in a decision that shot down a major policy goal of organizations supporting Michigan’s current automotive no-fault system.

On Dec. 26, 2012, County Circuit Court Judge ruled in favor of Coalition Protecting Auto No-Fault CPAN and Brain Injury Association of Michigan BIAMI’s motion for summary disposition, holding that the MCCA was a public body and, therefore, much of its rate-setting information must be disclosed pursuant to CPAN and BIAMI’s FOIA request. The MCCA appealed that ruling.

In its published Opinion, the Court of Appeals ruled in favor of the MCCA on all counts.

New Mexico

The New Mexico Court of Appeals has ruled that an insurer must reimburse a workers’ compensation claimant for the cost of medical marijuana to treat his low back pain, even though the substance is illegal under federal law. In Vialpando v. Ben’s Automotive Service and Redwood Fire & Casualty, the appellate court rejected an argument that an order to reimburse a claimant for medical marijuana would force the employer to violate federal law. We feel medical marijuana will be a priority issue throughout the states in 2015.

North Carolina

There is a provision in the Governor’s budget aimed to reduce physician dispensing, workers’ compensation doctors repackaging prescription drugs and selling them at higher rates. The House budget contains a similar provision to the one contained in the Governor’s, although the Senate budget did not include this provision. We’re unsure what will happen when they start discussing in conference committee, but it’s a very positive signal to the industry they’re willing to tackle the issue.
